Arbitration

Arbitration is increasingly seen by large corporations and financial institutions as their preferred dispute resolution procedure. Its advantages include privacy and confidentiality, speed, a neutral forum and the global enforcement of awards under the New York Convention.

Masseys’ specialist arbitration practitioners combine creative problem-solving techniques with a modern and commercial approach towards dispute management. Our aim is to achieve our clients’ objectives in a focused and cost effective manner. Our practitioners have all had significant experience of conducting arbitrations, particularly international disputes.

We have acted for large companies in ICC, LCIA, LMAA, GAFTA, UNCITRAL and FOSFA arbitrations both in the preparation and conduct of the claims and as advocates in a number of hearings. We also advise on the choice of forum clauses (Court jurisdiction v. arbitration), the choice of arbitral institution, the drafting of arbitration clauses and on the appointment of arbitrators.

In appropriate cases each of the partners of Masseys will accept appointment as arbitrators.

    •   acted for a large Japanese manufacturing company in a US$100million LCIA arbitration against an Indian distributor involving the alleged sale of defective goods;  
    •   acted for Samsung, the well known Korean electronics company, in a LCIA arbitration involving the import of bulk electronic components into the UK;  
    •   acted for a US company defending claims by an Indian distribution of food products in a US$60m ICC arbitration;  
    •   acted as second chair in an international commercial arbitration for a multi-national software company in respect of a corporate acquisition dispute;  
    •   acted in a US$9m ICC arbitration in an offshore energy and shipping dispute; and  
    •   acted for oil traders in various disputes with ship owners and counterparties.
