Fiona Gillett

Fiona Gillett is a Senior Associate at Masseys LLP, having joined Masseys in September 2006 from global law firm, Baker & McKenzie where she had spent 6 years as a qualified solicitor.

Fiona's practice involves a broad range of advisory work, commercial litigation and dispute resolution, often international in nature, relating to general commercial litigation, commercial fraud and product liability work, as well as international commercial arbitration, with a focus on claims for breach of trust/fiduciary duties. Clients Fiona has represented include banks, multinational corporations, PLCs. foreign State entities, financial institutions and individuals.

Representative cases and matters Fiona has recently worked on include acting for a PLC in obtaining an emergency without notice injunction restraining the defendants’ use of confidential information, acting for two company directors in defending a misfeasance claim brought by the company liquidators, advising a multi-national in a claim for fraudulent misrepresentation against the former Chairman and majority shareholder of an English company, acting for a national coffee franchisor in relation to a large franchise dispute, and acting over several years for the claimant in the Grupo Torras litigation involving the enforcement of a US$800 million judgment against Trust and personal assets located in the Cayman Islands, Jersey, The Bahamas, Switzerland, Spain, Singapore and elsewhere following a massive US$500 million fraud by key management personnel.

Fiona spent a year (2004) practising in Baker & McKenzie's Toronto office during which time she acted as second chair in an international commercial arbitration for a multi-national software company in respect of a corporate acquisition dispute, as well as acting for a large manufacturer of aircraft engines in a Canadian insolvency (Chapter 11 type) claim for misrepresentation involving a debt trade, the resolution of a double proof issue, and related transactional matters, against Air Canada.
