Insurance & Reinsurance Disputes

Masseys’ broad spectrum practice involves acting in both direct insurance disputes as well as in facultative and treaty reinsurance cases. Masseys’ clients include large corporate insureds, foreign cedants, London market insurers and reinsurers in both the Lloyd’s and Companies markets as well as various insurance/reinsurance brokers.

Masseys’ lawyers:

    •   act for various trade credit and political risk insurers and various Lloyd’s led underwriters and members of the Companies Market. Masseys is presently involved in various claims arising out of London market insured risks in Africa, South America and the Middle East (Masseys acts on both coverage and recovery issues);  
    •   successfully acted for La Positiva in claims against London market reinsurers arising out of bankers’ blanket bond fidelity policies. This case culminated in a reported judgment in La Positiva’s favour (La Positiva -v- Jessel [2000] WLR 33281288);  
    •   were involved in billion dollar proceedings defending a large insurer in international litigation arising out of September 11;  
    •   acted for a significant Latin American insurer in negligence claims against London market producing and placing brokers arising out of the reinsurance of energy risks;  
    •   acted for a well-known London market insurance broker in a dispute between the shareholders relating to the compulsory acquisition of shares;  
    •   acted for various professional firms in coverage disputes with their professional indemnity underwriters;  
    •   have acted on various aspects of marine insurance matters (Cargo and Hull & Machinery) for and against London market underwriters; and  
    •   are currently acting for United Insurance Brokers Ltd in their high profile claim against Marsh and various others.
